Q: I was ordered to pay child support a year ago, but lost my job and have been unemployed for several months. I have been unable to find any work in my field and am getting behind on my child support payments. I am afraid I will go to jail. What can I do?
A: You probably need to have a motion filed on your behalf to temporarily lower or suspend your child support payments. It sounds as if your circumstances are substantially different from what they were when the child support payment was established. A motion to the court in this regard would alllow a judge to determine whether you should be granted some relief in your payments. Q: How much do you all charge to represent people for DWI’s? I got one and I’m worried about going to jail. Do I need to be present if you represent me, and also what can happen to me if I plead guilty?
A: DWI’s are very serious charges. The length of a prison sentence is determined by a number of factors including prior DWI’s and your driving record. Our fee for DWI’s varies depending on whether the matter will need to be taken to trial. A client must always be present for these matters.
An attorney is highly recommended because these types of cases could land you in jail/prison. Our job as attorneys would be to evaluate your case. If we do not think we can prevail at trial, then our goal would be to seek a punishment that does not involve active prison time and that does the least amount of damage to your license/ insurance.

Q: My wife has taken out a domestic violence protecive order against me. At first I felt like I could handle it myself, but my court date is coming up and I’m wondering whether having an attorney there would be smart. Does your firm handles these matters?
A: Yes we handle these types of hearings. Having an attorney at one of these hearings is extremely important. A domestic violence protection order in N.C lasts one year and can be renewed at the end of each year. It can also have further implications such as limitations on having firearms. An attorney can assess whether your alleged conduct rises to the level of a DVPO and if necessary, defend you from this action.

Q: I was in an auto accident and the insurance company of the driver that hit me does not want to pay me for the time I was out of work. Do I need an attorney to get involved with this?
A: It is highly advisable to have an attorney handle your case in an automobile accident. You may be entitled to compensation that you are not aware of, including lost wages. Q: My landord has demanded that I immediately leave the premises because I was two weeks late with my last rent payment. Do I have to leave immediately?
A: A landlord is required under N.C law to serve you with a notice of eviction/eviction hearing. It is at this hearing in front of a magistrate that it is determined whether you should be evicted from the premises. Whether you will be evicted depends on the terms and conditions of your lease. Q: I got a traffic ticket going 69 mph in a 55 mph zone and I was writing to ask whether I should just pay the ticket? This is my first traffic ticket and I’m not sure what is best to do.
A: Paying for traffic tickets is not advisable prior to seeking a reduction in the speed on the traffic ticket. Speeding tickets can very often lead to points on both your driver license and insurance. These points could cause higher insurance premiums and a possible suspension of the drivers license. You or an attorney on your behalf can seek to have the speed of the ticket reduced.
A 69/55 mph zone in Harnett County where I practice can often be reduced to improper equipment which puts no points on you license or insurance.I would advise you to consult with an attorney prior to doing anything with your case.
